Organizer:

1. ExxonMobil Malaysia Sdn Bhd (“The Company”) is the organizer of this “Win RM650,000 worth of prizes” Contest (“Contest”).

Eligibility:

1. This Contest is open to all Smiles card members of the Smiles Driver Rewards Loyalty Program (“Smiles”) except Fleet Card and Diesel Discount Card members, with Malaysian citizenship, aged eighteen (18) and above (“Contestants”) subject to the following Terms and Conditions. All transactions for the purpose of this Contest must be swiped together with Smiles card for it to be considered as a valid entry.
2. This contest is open to all Contestants, except for the following category of person who are NOT ELIGIBLE to participate in the contest:
   • Permanent/Contract Employee of the ExxonMobil Subsidiaries in Malaysia;
   • The Company station dealers; and
   • Employees of advertising and promotional agencies for The Company (hereinafter referred to as “Non-Eligible Participants”).
   • The immediate family members (father, mother, spouses and children) of the Non-Eligible Participants are also not permitted to participate in the Contest.

Contest Period:

1. The Contest Period will run from 24 February 2012 to 24 May 2012, both dates are inclusive (“Contest Period”).

The Contest:

1. To join the Contest, Contestants have to make a cumulative purchase of RM30.00 on Synergy F-1, Synergy 5000, Synergy Diesel and/or BioDiesel products at any Esso or Mobil service station in a single or multiple receipts via cash or credit card. All purchases must be swiped together with the Smiles card.
2. Every cumulative RM30.00 spent in single or multiple receipts entitles the Contestants to one (1) entry. For example, a transaction of RM70 will entitle the Contestants to two (2) entries.
3. No contest form or transaction receipts are required. Contestants will be deemed eligible automatically when in compliance with all the Terms and Conditions stated herein. By being eligible and hence participating in the Contest, each Contestant is deemed to have agreed to adhere to the Terms and Conditions herein.
4. Based on all the entries received, the Company will then select several Contestants (“Shortlisted Candidates”). The Company’s decision on all matters relating to this Contest (including the selection of Shortlisted Candidates) shall be final and binding. No correspondences relating to the selection of winners will be entertained.
5. If the Smiles card is not swiped to earn loyalty points, and/or purchase does not meet the required criteria, the entry will be deemed invalid.
6. The Shortlisted Contestant(s) will be contacted by The Company or its appointed representative via phone (the telephone number as available in the Smiles database) and is required to answer one (1) Contest question correctly to qualify as a winner. In the event a Shortlisted Contestant in The Company’s sole discretion is unreachable, The Company hereby reserves the right to select another Shortlisted Contestant.

The Contest Prizes and Lucky Draw Period:

* The winners may choose their shopping vouchers from these merchants: Jusco, Isetan, Robinson, Parkson, Giant, Tesco, Metrojaya, Sen Heng, Poh Kong, Tangs, Harvey Norman, Ikea, Tai Thong Restaurants, Carrefour, Courts.

Other Terms and Conditions:

1. The name of all winners will be notified through a notification letter and announced via a winner announcement poster at all Esso and Mobil service stations and at www.Esso-Mobil-Smiles.com.my website.
2. In the event that any Contest entry or Prize is awarded to a person who:
   • is not eligible for the Contest; and/or,
   • has committed or is suspected of committing any fraudulent or wrongful acts in relation to his use of Smiles card
   The Company reserves the right to disqualify such person from participating in the Contest and/or receiving the Prize.
3. All winner recorded by The Company shall be final and conclusive.
4. The Company will send a letter to notify the Contest winners on the result and prize won (“Notification Letter”) (the home address as available in the Smiles database). Upon receipt of the Notification Letter, the winner must then contact The Company within 14 days from the date of the Notification Letter failing which, the Company reserves the right to select a new winner. All Prizes must be claimed within three (3) months from the date of the Notification Letter.
5. For the Grand Prize winners who choose the shopping vouchers, customers need to fill in and sign back the acknowledge letter with members’ details to The Company. The Company shall courier the voucher to winners within 6-8 weeks upon the submission of acknowledgment letter with complete details.
6. For Grand Prize winners who choose housing installment, customers need to fill in and sign back the acknowledgment letter with member’s details and mortgage loan details to The Company.
7. For Grand Prize winners who choose travel holiday voucher, our chosen travel agency will contact the winners to discuss the details upon the announcement. The Company will only cover the expenses as the prize amount. Customers may have to bear the cost if the selected travel package exceeds the prize amount.
8. All prizes are non-transferable and must be collected personally by the winner or nominated proxy, approved by The Company.
9. If a Prize is unclaimed by the winner within the stipulated period, the winner automatically surrenders his/ her right to the Prize and shall not have any claim, thereafter and in such an event, The Company reserves the right to transfer the Prize to another chosen Contestant.
10. For Consolation Prize winners, RM300 Parkson cash voucher will be couriered to customers within 4-6 weeks upon the winner announcement.
11. All Prizes are non-transferable and not exchangeable for cash or any other items or packages. Winners are not allowed to claim the Prizes after the stipulated period.
12. The Company reserves the right to cancel, shorten, extend, suspend or terminate the Contest Period at any time prior to the expiry of the Contest Period without prior notice. The Company also reserves the right to vary, modify, delete or change any of the Terms and Conditions herein contained at any time at its absolute discretion without prior notice. For avoidance of doubt, any cancellation, extension, suspension or termination of the Contest Period at any time prior to the expiry of the Contest Period shall not entitle the Contestants to claim any compensation from The Company for any and all losses or damages suffered or incurred by the Contestants as a result of the said cancellation, extension, suspension or termination.
13. The Company reserves the right to use the names, addresses, photographs, and testimonies of the Contestants in advertisements and other forms of publicity in conjunction with the Contest. The Contestants' participation in the Contest and agreement to be bound to the terms and conditions herein shall be deemed to indicate their implied consent to such use, without further notice, payment or consideration whatsoever.
14. By entering into the Contest and accepting a Prize, Prize winners agree that ExxonMobil has the right to picture, tape or portray them as Contest winners in any manner whatsoever as ExxonMobil may in its absolute discretion decide, and to exhibit this material in for all Contest-related advertising, marketing and publicity purposes without any compensation whatsoever, subject to applicable laws and regulations. Participants and eventual winners of the Contest are hereby notified and deemed to consent to ExxonMobil’s right to use their name, voice, picture or footages, or the content of their entries solely for the above mentioned purposes.
15. The Company reserves the right to provide substitute Prize(s) of similar value, if necessary.
16. Contestants hereby agree to release the Company, its directors, officers, employees and agents, including without limitation, its parent companies, subsidiaries, affiliates, employees, agencies and branches, as well as all Contest partners / sponsors and all others associated with the development and execution of this Contest, from and against any and all liability for injury, loss or damage of any kind (whether direct, indirect or consequential) to or in any way arising from this Contest and the awarding and the use or misuse or possession of any Prizes awarded, including liability for personal injury, death or property damage, except where prohibited or limited by law. All winners acknowledge that to the extent permissible by law, the Prizes are awarded by the Company on an “as is” basis without any warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, and non-infringement.
17. Contestants shall fully indemnify and hold harmless the Company, its directors, officers, employees, agents and assigns against any and all losses, liabilities, costs, claims, charges, expenses, actions or demands (including legal costs), whether direct or indirect arising out of a breach by him or her of these Terms & Conditions.
18. This Contest is governed by the laws of Malaysia and all disputes are subject to the exclusive jurisdiction of the courts of Malaysia.
19. If for any reason any part of this Contest is incapable of running as planned, the Company may in its sole discretion cancel, terminate, modify or suspend the Contest, or invalidate any affected entries without any liability or any obligation to continue the Contest.
20. The invalidity or unenforceability for any reason of any part of these Terms & Conditions shall not prejudice or affect the validity or enforceability of the remaining parts and each part of these Terms & Conditions is distinct and at all time severable from the rest of the Terms & Conditions.
21. The Company shall not be responsible or liable for any claims, loss or damage whatsoever, resulting from or in connection with this Contest or the Prizes given out through this Contest.
22. The Company is the final authority to decide on the interpretation of these Terms and Conditions and as to any other matters relating to this Contest.
23. All other Smiles Terms and Conditions apply.
